Authorized Retailer Terms & Conditions
To protect the reputation and integrity of Marte Farke LLC DBA Marté Farké (" Marté Farké") and our commitment to quality, customer satisfaction and non-fungible fashion, the following Authorized Retailer Terms & Conditions ("terms") are effective immediately for authorized retailers of Marté Farké products ("products"). By purchasing from Marté Farké, you ("customer") agree to adhere to these Terms. Please review carefully.
Manner of Sale
Marté Farké sells products exclusively to end users. Sales exceeding typical personal use quantities are prohibited. Customers must not sell, ship, or invoice Products without Marté Farké's prior written consent.
Marté Farké products are sold exclusively through authorized channels to ensure the quality and integrity of our products and brand. Unauthorized sales, including but not limited to sales through third-party marketplaces without Marté Farké's explicit written consent, are strictly prohibited. Products purchased from unauthorized sellers will not eligible for Marté Farké’s warranties, guarantees, or recall protections. This policy is in place to maintain the high standards our customers expect and to support ethical, sustainable business practices.
Resale Prohibited
Customer acknowledges and agrees that purchases of Marté Farké products are intended for end consumers only and are therefore not permitted for resale. Customer shall not engage in, facilitate, or authorize the resale of products, directly or indirectly to any third party, including but not limited to third-party marketplace sellers, without the explicit prior written consent of Marté Farké. This restriction is in place to maintain the exclusivity, brand integrity and quality assurance of Marté Farké products. Any attempt to resell products outside of authorized channels will be considered a breach of these terms and may result in legal action to protect Marté Farké LLC's intellectual property and business interests. Marté Farké reserves the right to monitor for compliance with this provision and take appropriate action against unauthorized resale activities.
Product Authentication Services
Original Purchaser Authentication: Marté Farké is committed to the quality and authenticity of our products. To protect the integrity of our brand and provide added value to our original purchasers, we offer exclusive product authentication services. This service is designed to confirm the authenticity of Marté Farké products for original purchasers, reinforcing our dedication to quality and customer satisfaction.
Eligibility: The product authentication service is exclusively available to original purchasers of Marté Farké products. To qualify for this service, Customer must provide proof of purchase directly from Marté Farké.
Service Request: Original purchasers seeking to utilize the product authentication service are invited to contact us at mf@martefarke.com. Please be prepared to provide your proof of purchase and any additional information requested by our team to facilitate the authentication process.
Disclaimer: The product authentication service provided by Marté Farké is intended solely for the benefit of original Customers. This service does not constitute a warranty, nor does it affect any warranties that may apply to the Product. Marté Farké reserves the right to limit or deny authentication services at its discretion, particularly in cases where proof of purchase cannot be verified or the item in question does not meet our criteria for authenticity.
Brand Representation and Conduct
Marté Farké believes in creating a welcoming and respectful environment for all our customers and community members. As such, we request that our products are used in a manner that reflects our brand's values and image.
Prohibited Uses:
- Discrimination and Hate Speech: Customers are prohibited from using Marté Farké products in any way that promotes hate speech, discrimination, intolerance, or harassment based on race, gender, sexuality, religion, nationality, disability or any other characteristic.
- Political Association: Marté Farké maintains a neutral stance on political matters. Customers are prohibited from using our products in a manner that implies endorsement or opposition to any political campaigns, parties, figures or issues.
- Damaging Brand Image: Associating Marté Farké products with activities or content that could significantly diminish the brand's reputation (including but not limited to illegal activities and morally questionable or offensive content) is strictly forbidden.
Customer Expectations and Responsibilities:
- Respect and Inclusivity: We encourage all customers to use Marté Farké products in a way that fosters a respectful and inclusive environment.
- Brand Representation: When publicly sharing content related to or featuring Marté Farké products, please ensure that it aligns with our brand's values and contributes positively to our community.
Orders
Orders for Products made by Customer shall be processed according to the current product order, shipment, and return procedures, subject to amendment at Marté Farké's sole discretion. Marté Farké reserves the right to reject any orders, in whole or part, for any reason. Additional or differing terms proposed by Customer are rejected unless explicitly agreed to in writing by Marté Farké.
Product Care & Quality Controls
Customer is responsible for inspecting Products promptly upon receipt for defects or tampering. Any defects must be reported to Marté Farké immediately.
Recalls and Consumer Safety
Customer agrees to cooperate with Marté Farké regarding any Product recall or consumer safety information dissemination.
Unauthorized Modifications Prohibited
Marté Farké sells Products in their original packaging. Alterations, relabeling, repackaging, and bundling without Marté Farké's consent are prohibited.
Intellectual Property
Marté Farké retains all rights over its trademarks, service marks, and intellectual property. The Customer receives a limited license to use Marté Farké's intellectual property strictly for promoting Marté Farké Products, purposes covered under fair use or otherwise permitted by law.
Material Differences
We guarantee that all Marté Farké products sold directly to Customers are authentic and free from material differences. A "material difference" in the context of this policy refers to any variation that affects the value, functionality, or safety of the product, distinguishing it from authentic products sold by Marté Farké. Our authentication service is designed to identify such material differences, ensuring that original purchasers possess genuine Marté Farké products that are eligible for all services providied by Marté Farké including but not limited to authentication services, warranties, guarantees and product safety recalls.
Monitoring and Compliance
Marté Farké reserves the right to monitor, review and address any instances where the products are used in violation of this policy. While we encourage freedom of expression, it is imperative that the use of our products aligns with our brand values and ethics.
By purchasing and using Marté Farké products, you agree to adhere to these terms. Our goal is to create a positive impact within our community and beyond and we thank you for your support and cooperation in achieving this vision.
Termination
Violation of these terms may result in immediate termination of Customer's authorization, among other remedies. Upon termination, Customer must cease promoting the Products, implying any association with Marté Farké, and using Marté Farké's intellectual property.
Injunctive Relief
Marté Farké is entitled to injunctive relief for any breach of these terms, acknowledging that monetary damages may be insufficient.
Miscellaneous
Marté Farké reserves the right to amend these terms, with amendments effective immediately. Continued engagement with Marté Farké Products or intellectual property post-amendment signifies acceptance of these modifications.
